Business and Professions Code §21705 requires a notice of lien sale and a blank declaration in opposition, with a sale date at least 14 days out unless that declaration comes back.
A valid declaration ends the sale path
Section 21710 sends a timely, valid declaration to a court action. Selling anyway is the failure mode, not a manager override.
2025 advertising is not a cure
The 2025 text of §21707 lets operators advertise in a newspaper or pair one newspaper insertion with seven days on a public online auction site. Ads do not repair a missing form or a late proof.
